INSPECTION LIABILITY WAIVER AND RELEASE OF CLAIMS — Version 3.0
ELECTRONIC ACKNOWLEDGEMENT. By typing your full legal name and submitting this form, you confirm that you have read and agreed to this Liability Waiver and the Service Agreement and intend your typed name to serve as your electronic signature.
1. PARTIES AND AGREEMENT
This Liability Waiver is between Pawsitive Mould Detection Inc. (the “Company”) and the person booking or authorizing the inspection (the “Client”). By electronically acknowledging this Waiver, the Client confirms that they have read, understood, and voluntarily agreed to its terms. Nothing in this Waiver excludes rights or liabilities that cannot legally be excluded under applicable Ontario law.
2. NATURE AND SCOPE OF THE SERVICE
A professionally trained and certified K9 mould-detection team will attend the property and conduct a systematic room-by-room canine search of the accessible areas included in the booked service.
A canine indication identifies the strongest accessible mould-related odour location detected by the trained K9. It does not confirm mould species, concentration, viability, health risk, or the cause of moisture.
A no-indication result means the trained K9 did not provide an indication in the accessible areas searched at the time of inspection. It does not guarantee that the property is mould-free or rule out concealed, inaccessible, inactive, previously remediated, or low-odour contamination.
Search conditions may be influenced by airflow, temperature, humidity, masking odours, recent cleaning or painting, and physical accessibility at the time of inspection.
The report documents the scope of the canine search, the accessible areas inspected, any canine indications observed, any exclusions, and the handler’s recorded observations. It is not a laboratory, environmental, engineering, medical, or structural assessment.
3. SERVICE LIMITATIONS AND RESPONSIBILITY
The Company is not responsible for conditions that were concealed, inaccessible, masked, outside the agreed inspection scope, or not indicated by the K9 during the inspection, except where liability cannot legally be excluded.
Any claim arising from the inspection will be assessed in relation to the scope of the service provided, the inspection findings, and the fee paid. The Company reserves all rights and remedies available under Ontario law.
After a canine indication, the Client may choose to arrange further investigation, testing, or corrective work through a qualified independent professional. The Company does not require or arrange laboratory testing.
4. CLIENT PREPARATION AND DISCLOSURE
The Client must ensure lawful access to the property and remain available by phone during the inspection. Where required for safety, access, or property supervision, a responsible adult aged 18 or older must remain on site.
The Client must disclose any known or suspected mould, previous remediation, leaks, flooding, water damage, asbestos, structural hazards, pest treatments, chemical use, or other conditions that could affect safety or the canine search.
The Client must avoid using air fresheners, scented products, deodorizers, strong cleaning chemicals, or fresh paint in the inspection areas before the appointment. Any recent use must be disclosed to the Company because it may affect search conditions.
All household pets must be secured in a fully enclosed area away from the inspection route before the K9 team enters the property and must remain separated for the duration of the canine search.
During the canine search, the handler may require clients, occupants, and other persons to remain outside or in a designated area where their presence could distract, influence, or interfere with the K9 team.
5. PRE-INSPECTION WALKTHROUGH AND SAFETY
Before the K9 is removed from the vehicle, the handler will complete a walkthrough of the property with the Client to confirm lawful access, accessibility of the inspection areas, site safety, pet control, and the location of all occupants.
The Company may refuse to begin or may stop the inspection if unsafe, concealed, inaccessible, or otherwise unsuitable conditions are identified.
The Company may postpone, reschedule, or discontinue an inspection where weather, temperature, unsafe property conditions, K9 health, handler safety, or other operational circumstances could compromise the welfare of the K9 team or the reliability of the search.
The Company maintains business insurance appropriate to its operations. Evidence of current coverage may be provided where reasonably required.
6. REPORT USE AND THIRD-PARTY RELIANCE
The report is prepared for the named Client and may be shared with third parties for purposes related to the property, including insurance, restoration, real estate, legal, or property-management matters. The Company is not responsible for decisions made by third parties based on the report beyond the scope of the inspection service.
7. PRIVACY AND RECORDS
The Company collects personal information only for booking, service delivery, communication, payment, reporting, legal, insurance, and business-record purposes. Client information and inspection records are stored in secured electronic systems with access restricted to authorized personnel. The Company does not sell client information or disclose it to third parties except with consent, as required to deliver the service, or where required by law. Personal identifying information will be reviewed under the Company’s retention policy and may be removed, anonymized, or securely deleted when it is no longer required. Operational inspection records may be retained as part of the Company’s permanent business and service history.
8. GOVERNING LAW
This Waiver is governed by the laws of Ontario and the applicable federal laws of Canada. If any provision is found invalid or unenforceable, the remaining provisions will continue to apply.

The Company is not responsible for decisions made by third parties based on the report beyond the scope of the inspection service.

7. CANCELLATION, ATTENDANCE, AND REBOOKING
The Client may cancel or reschedule without charge before the K9 team departs for the appointment. If the K9 team travels to the property and the inspection cannot proceed because access was not provided, the Client was unavailable, or required site conditions were not met, the Company may require a $75 attendance fee before accepting another booking for that property.
8. FEES AND PAYMENT
Fees are based on the selected service, property size, service zone, and approved add-ons.
Payment is due after the inspection is completed and before the inspection report or results are released. If payment is not received, the Company may withhold the report and any inspection findings.
Any applicable credit-card processing surcharge will be disclosed before payment is processed. E-transfer and cash carry no surcharge.
9. PROPERTY-DAMAGE CONCERNS
Any concern regarding property damage believed to have occurred during the inspection must be reported to the Company as soon as reasonably possible, with supporting details and photographs where available.

14. FINAL ACKNOWLEDGEMENT
By submitting this form, the Client confirms that the information provided is accurate, the property will be prepared as required, the service limitations have been understood, and payment is due before the inspection report or findings are released.
